Ingushetia's public prosecutor's office lodges complaint against ChKNS to Supreme Court

ATTENTION! PUBLIC PROSECUTOR’S OFFICE OF REPUBLIC OF INGUSHETIA LODGED A COMPLAINT IN COLLEGE OF THE SUPREME COURT AGAINST REGIONAL PUBLIC MOVEMENT “CHECHEN COMMITTEE FOR NATIONAL SALVATION”
On February 3, 2005 will continue of trial of Regional Public Movement “ Chechen Committee for National Salvation” with Public Prosecutor’s Office of Republic of Ingushetia on the fact of a recognition of information materials are extremist. In the previous production of Public Prosecutor’s Office of Republic of Ingushetia it was mentioned, that information materials of our organization are directed to kindling of national discord assistance to realization of the extremist activity appearing in condemnation and discredit of activity of law enforcement bodies and justifications of actions of illegal armed unit acting in the territory of the Chechen Republic.
Yesterday to our office the summons with the invitation of Regional Public Movement “ Chechen Committee for National Salvation” on February 3, 2005 to investigation in judicial board of the Supreme Court of Republic of Ingushetia owing to appeal lodged by Public Prosecutor’s office of Republic of Ingushetia about decision of Nazranovsky Regional Court from October 25, 2004 has been received.
Briefly we remind prehistory of the given law case. After the carried out examination on July 5, 2004 the employee of Ministry of Justice in Nazranovsky Regional Court under 12 press releases selected during examination by the expert of Ministry of Justice, Barkinhoev H.M., by Republican Public Prosecutor’s Office representation was brought about a recognition of information materials of Regional Public Movement “ Chechen Committee for National Salvation” are extremist.
Law case of Public Prosecutor’s Office of Republic of Ingushetia against Regional Public Movement “Chechen Committee for National Salvation” was investigated by the civil order and more than once postponed for some reasons. But, finally, the last session has passed on October 25, 2004.
Defence of Regional Public Movement “Chechen Committee for National Salvation” was represented by lawyers of organization Sherip Tepsaev and Zarema Gandaloeva by whom as arguments were represented two conclusions of INDEPENDENT EXPERT LEGAL COUNCIL.
It was proved, that work of Regional Public Movement “ Chechen Committee for National Salvation” is carried out according to the Constitution of the Russian Federation where in article 29, paragraph 4 is precisely spoken that to everyone is guaranteed freedom of thought and speech, and also according to article 10 of the European convention guaranteeing freedom of expression of opinion.
In connection with that reasons of Public Prosecutor’s Office of Republic of Ingushetia on the occasion of presence in information materials of Regional Public Movement “Chechen Committee for National Salvation” the aspects testifying extremism and other accusations were recognized unreasonable and the representative of Public Prosecutor’s Office of Republic of Ingushetia, Aushev Magomed had no choice but to accuse human rights organization of kindling social discord. However and this attempt to slander human rights activists failed.
As a result Nazranovsky Regional Court in the name of the Russian Federation decided: In the suit of the public prosecutor of Republic of Ingushetia in defence of interests of the Russian Federation to Regional Public Movement “Chechen Committee for National Salvation” about a recognition of the information materials spread in a computer network “ Internet” in press releases № 550, 553, 557, 559, 560, 562-564, 566-570 are extremist to adjudicate.
As we know in the court the given case was brought at special services' suggestion about what the letter signed by the former chief of UFSB (Administration of Federal Security Service) of the Russian Federation in Republic of Ingushetia general - major Sergey Koryakov testifies. That fact is obvious that the case was staged and was characterized as the political demand however despite of all peripeteias validity has triumphed and by the court was pronounced fair judgment.
We note that the Nazranovsky Regional Court has a reputation of unbiased court about what the representative of the Russian Federation in the European court, Paul Laptev asserted at secession of the European court in Strasbourg where the first six Chechen cases were investigated on October15, 2004. Namely P. Laptev giving arguments on case of Magomed Hashiev concerning protection of Hashiev stated that Nazranovsky Regional Court took conclusion on Hashiev’s case and this court is not Shariatsky!
It not the first attempt to blacken and intimidate human rights activists and journalists who are engaged in gathering and distribution of reports on murders abductions and about the facts of marauding committed by representatives of power structures in the territory of the Chechen Republic, trying to declare their hard work provocative and extremist.
This time Public Prosecutor’s Office of Republic of Ingushetia which has appealed decision of Nazranovsky Regional Court pronounced judgement in the name of the Russian Federation has to prove again that Regional Public Movement “ Chechen Committee for National Salvation” are engaged in extremist activity but now in the Supreme court of Republic of Ingushetia.
Unfortunately any attempt of employees of human rights organizations and journalists to inform the Russian and international public the truth in our country is taken as infringement of the Russian legislation. Besides it threatens their freedom, safety and lives examples of that are more than enough in our practice.
It is obvious that the work armed at protection of rights and freedoms of the citizen in ours “democratic” country is unsafe the fact of abduction the known Chechen lawyer, the employee of Regional Public Movement “Chechen Committee for National Salvation”, Mahbut Magomadov on January 20, 2005 in Grozny the destiny and a site of who till now are unknown testifies.
The journalist of News Agency «France-press», abducted on June 4, 2003 by employees of unknown power structures Astamirov Ali who up to now to this day is among the disappeared suffered the same fate.
Example of illegal actions, committed by special services regarding human rights activists and journalists the unsanctioned search which has been carried out by employees of UFSB of the Russian Federation in Republic of Ingushetia in the office of information Center “ Council of nongovernmental organizations” which accompanied with flagrant infringements of human rights and confiscation of system blocks of computers for two days.
And similar crimes regarding those who try to achieve validity and to inform people the truth will commit as long as criminals will feel impunity of their actions.
